Terms of Service
Introduction
Please read these Terms of Service ("Terms") carefully. They contain the legal terms and conditions that govern your use of services provided to you by 2xanadu, including information, text, images, graphics, data or other materials ("Content") and products and services provided through www.bespoke-creative.net well as all elements, software, programs and code forming or incorporated in to www.bespoke-creative.net (the "Service"). This Service is operated by 2xanadu. ("2xanadu"). 2xanadu is also referred to in these Terms as "we", "our", and "us".
By using our Service, you agree to be bound by Section I of these Terms ("General Terms"), which contains provisions applicable to all users of our Service, including visitors to the Bespoke website (the "Site"). If you choose to register as a member of our Service or purchase products from the Bespoke Shop, you will be asked to check a box indicating that you have read, and agree to be bound by, the additional terms set forth in Section II of these Terms ("Additional Terms").
Section I: General Terms
1. Availability
This Service is provided by 2xanadu on an "AS IS" and "AS AVAILABLE" basis and 2xanadu reserves the right to modify, suspend or discontinue the Service, at its sole discretion, at any time and without notice. You agree that 2xanadu is and will not be liable to you for any modification, suspension or discontinuance of the Service.
2. Privacy
2xanadu has a firm commitment to safeguarding your privacy. Please review 2xanadu's Privacy Policy. The terms of 2xanadu's privacy policy are incorporated into, and form a part of, these Terms.
3. Trademarks
All brand, product and service names used in this Service which identify 2xanadu or third parties and their products and services are proprietary marks of 2xanadu and/or the relevant third parties. Nothing in this Service shall be deemed to confer on any person any license or right on the part of 2xanadu or any third party with respect to any such image, logo or name.
4. Copyright
2xanadu is, unless otherwise stated, the owner of all copyright and data rights in the Service and its contents. 
5. External Links
2xanadu may provide links to third-party websites or resources. You acknowledge and agree that 2xanadu is not responsible or liable for: the availability or accuracy of such websites or resources; or the Content, products, or services on or available from such websites or resources. Links to such websites or resources do not imply any endorsement by 2xanadu of such websites or resources or the Content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.
6. Conduct
You agree that you shall not interfere with or disrupt (or attempt to interfere with or disrupt) this Service or servers or networks connected to this Service, or to disobey any requirements, procedures, policies or regulations of networks connected to this Service; or provide any information to 2xanadu that is false or misleading, that attempts to hide your identity or that you do not have the right to disclose. 2xanadu does not endorse any content placed on the Service by third parties or any opinions or advice contained in such content. You agree to defend, indemnify, and hold harmless 2xanadu, its officers, directors, employees and agents, from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and expert fees, arising out of or in any way connected with your access to or use of the Services, or your violation of these Terms.
7. Disclaimer of Warranty and Limitation of Liability
2XANADU MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED AS TO THE OPERATION OF THE SERVICE, OR THE CONTENT OR PRODUCTS, PROVIDED THROUGH THE SERVICE. YOU EXPRESSLY AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. 2XANADU DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. 2XANADU MAKES NO WARRANTY AS TO THE SECURITY, RELIABILITY, TIMELINESS, AND PERFORMANCE OF THIS SERVICE. YOU SPECIFICALLY ACKNOWLEDGE THAT 2XANADU IS NOT LIABLE FOR YOUR DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT, OR SUCH CONDUCT BY THIRD PARTIES, AND YOU EXPRESSLY ASSUME ALL RISKS AND RESPONSIBILITY FOR DAMAGES AND LOSSES ARISING FROM SUCH CONDUCT. EXCEPT FOR THE EXPRESS, LIMITED REMEDIES PROVIDED HEREIN, AND TO THE FULLEST EXTENT ALLOWED BY LAW, 2XANADU SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, EVEN IF 2XANADU HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE FOREGOING DISCLAIMERS, WAIVERS AND LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF ESSENTIAL PURPOSE OF ANY LIMITED REMEDY. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF OR LIMITATIONS ON CERTAIN WARRANTIES OR DAMAGES. THEREFORE, SOME OF THE ABOVE EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU. IN NO EVENT SHALL DEVIANTART'S AGGREGATE LIABILITY TO YOU EXCEED THE AMOUNTS PAID BY YOU TO 2XANADU PURSUANT TO THIS AGREEMENT.
8. Amendment of the Terms
We reserve the right to amend these Terms from time to time in our sole discretion. If you have registered as a member, we shall notify you of any material changes to these Terms (and the effective date of such changes) by sending an email to the address you have provided to 2xanadu for your account. For all other users, we will post the revised terms on the Site. If you continue to use the Service after the effective date of the revised Terms, you will be deemed to have accepted those changes. If you do not agree to the revised Terms, your sole remedy shall be to discontinue using the Service.
9. General
These Terms constitute the entire agreement between 2xanadu and you with respect to your use of the Service. 2xanadu's failure to enforce any right or provision in these Terms shall not constitute a waiver of such right or provision. If a court should find that one or more provisions contained in these Terms is invalid, you agree that the remainder of the Terms shall be enforceable. 2xanadu shall have the right to assign its rights and/or delegate its obligations under these Terms, in whole or in part, to any person or business entity. You may not assign your rights or delegate your obligations under these Terms without the prior written consent of 2xanadu. These Terms shall be governed by and construed in accordance with English law. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England.

Section II: Additional Terms
11. Registration
To register as a member of the Service or purchase products, you must be 18 years or lawfully permitted to enter into and form contracts under applicable law. In no event may minors submit Content to the Service. You agree that the information that you provide to us upon registration, at the time of purchase, and at all other times will be true, accurate, current and complete. You also agree that you will ensure that this information is kept accurate and up to date at all times. This is especially important with respect to your email address, since that is the primary way in which we will communicate with you about your account and your orders.
12. Password
When you register as a member you will be asked to provide a password. You are responsible for safeguarding the password and you agree not to disclose your password to any third party. You agree that you shall be solely responsible for any activities or actions under your password, whether or not you have authorised such activities or actions. You shall immediately notify 2xanadu of any unauthorised use of your password.
14. Submitting Content
Artist Materials - As a registered member of the Service, you will also be granted the privilege of submitting certain types of Your Content, known as "Artist Materials," for display in our competitions. Prior to submitting Artist Materials, you must accept the additional terms and conditions of the Competition Terms, which is incorporated into, and forms a part of, the Terms.
16. Conduct
You agree to be subject to and to conduct yourself in accordance with the 2xanadu Etiquette Policy. You are responsible for all of Your Content you upload, download, and otherwise copy, distribute and display using the Service. You must have the legal right to copy, distribute and display all parts of any content that you upload, download and otherwise copy, distribute and display. Content provided to you by others, or made available through websites, magazines, books and other sources, are protected by copyright and should not be uploaded, downloaded, or otherwise copied, distributed or displayed without the consent of the copyright owner or as otherwise permitted by law. Please refer to 2xanadu Copyright Policy for further details.
You agree not to use the Service:
   1. for any unlawful purposes;
   2. to upload, post, or otherwise transmit any material that is obscene, offensive, blasphemous, pornographic, unlawful, threatening, menacing, abusive, harmful, an invasion of privacy or publicity rights, defamatory, libelous, vulgar, illegal or otherwise objectionable;
   3. to upload, post, or otherwise transmit any material that infringes any copyright, trade mark, patent or other intellectual property right or any moral right or artist's right of any third party including, but not limited to, 2xanadu or to facilitate the unlawful distribution of copyrighted content or illegal content;
   4. to harm minors in any way, including, but not limited to, uploading, posting, or otherwise transmitting content that violates child pornography laws, child sexual exploitation laws or laws prohibiting the depiction of minors engaged in sexual conduct, or submitting any personally identifiable information about any child under the age of 13;
   5. to forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Service;
   6. to upload, post, or otherwise transmit any material which is likely to cause harm to 2xanadu or anyone else's computer systems, including but not limited to that which contains any virus, code, worm, data or other files or programs designed to damage or allow unauthorized access to the Service which may cause any defect, error, malfunction or corruption to the Service;
   7. for any commercial purpose, except as expressly permitted under these Terms;
   8. to sell access to the Service on any other website or to use the Service on another website for the primary purpose of gaining advertising or subscription revenue other than a personal blog or social network where the primary purpose is to display content from 2xanadu by hyperlink and not to compete with 2xanadu.
17. Suspension and Termination of Access and Membership
You agree that 2xanadu may at any time, and without notice, suspend or terminate any part of the Service, or refuse to fulfill any order, or any part of any order or terminate your membership and delete any Content stored on the 2xanadu Site, at 2xanadu’s sole discretion, if you fail to comply with the Terms or applicable law.
Privacy Policy

2xanadu respects your privacy. This Privacy Policy applies to our web sites, including www.bespoke-creative.net (collectively, the “2xanadu Sites” or “Sites”). This Privacy Policy explains what information we collect through the Sites, how we use that information, and what choices you have.
The 2xanadu Sites contain links to other web sites. This Privacy Policy does not apply to the practices of any companies or individuals that 2xanadu does not control, or any web sites that you link to from the 2xanadu Sites. You should use caution and review the privacy policies of any sites that you visit from ours to learn more about their information practices.
Please take a few moments to read this agreement. By accessing the 2xanadu Sites, you agree to accept the terms and conditions of this Privacy Policy and are aware that our policies may evolve in the future as indicated below.
What we collect
In various places on the 2xanadu Sites, we collect “Personally Identifiable Information,” such as your name, age, gender, postal address, telephone number, e-mail address, or other information that can be used to contact you or identify you as an individual. For example, we collect this information when you register for membership, sign up for e-mail newsletters and purchase products or services. From time to time in the future we may offer additional features, services, and promotional opportunities that would require you to submit Personally Identifiable Information to participate.
We also collect “Anonymous Information” such as your IP address, the type of browser you use, the pages on our Sites that you have visited, and the advertisements that you have clicked on. Your Personally Identifiable Information is linked to your Anonymous Information.
Like many Internet sites, we also use “cookies” to collect information. A cookie is a small data file that we transfer to your computer and is stored on your hard drive. When you visit our Site(s) the cookie identifies your computer to us so that you do not have to re-register each time you visit. We may also use cookies to measure the traffic to our Sites and the use of different services and features of the Sites. Advertisers that appear on the 2xanadu Sites may place cookies on your computer and their use of the information stored on those cookies is subject to their own privacy policies. You should visit their sites to learn about their information practices. Advertisers or other companies do not have access to 2xanadu’s cookies.
We do not intend that children will use our sites. We do not solicit or knowingly collect information from children under 13 years old, nor will we accept registration from them.
How we use the information we collect:
We use Personally Identifiable Information that you provide to communicate with you, to process orders for products and services, to customize advertising and content available on the 2xanadu Sites, to conduct research for internal purposes and to use such information to improve our services and the 2xanadu Sites. If you have uploaded Artist Materials pursuant to the Competitions Agreement, you have also authorised 2xanadu to use your name and biographical materials publicly for advertising and promotional purposes.
If you so choose, we will also use it to send you information about products and services that may be of interest to you. Later on in this Privacy Policy, we provide you with more information on what choices you have.
We use information that is not personally identifiable to determine how people use our web site and its services. For example this data tells us information including how often users click on our advertisements, which files are downloaded most frequently, and which areas of our site are the most popular. Analyzing this data allows us to improve the offerings on and performance of our site(s). Using your IP address, we can also determine the general physical location of a user and may at times use this information to better target advertising to users.
How we share information:
Except as noted below, 2xanadu does not share your Personally Identifiable Information with third parties unless you give us your permission or we need to share such information in order to provide products or services you have requested. For example, we use third parties to help with some of the products and services available on our site, such as processing payments and fulfilling orders for products through the 2xanadu Shop. We also engage third parties to assist us by tracking the number of visitors to the Sites that have "clicked-through" from specified promotions on third party sites and those visitors' activities on the 2xanadu Site. When we supply personally identifiable information to these third parties, we require them to use it only for the function they are helping us with.
When you see parts of our site with a prominent brand of another company, information you supply (or authorise for use) in that part of the site will be shared with the other company that is cooperating in providing the service. Please visit that company’s site to learn more about their information practices.
We aggregate the Anonymous Information that we collect and exchange it with advertisers and others who are interested in our services.
We will disclose Personally Identifiable Information when required by law or under the good-faith belief that such disclosure is necessary in order to conform to applicable law, comply with subpoenas, court orders or legal process served on 2xanadu, to establish or exercise our legal rights or defend against legal claims, and to protect the property or interests of 2xanadu, its agents and employees, personal safety, or the public. Under such circumstances, 2xanadu may be prohibited by law, court order or other legal process from providing notice of the disclosure, and 2xanadu reserves the right to not provide such notice at its sole discretion. If we become part of another organisation, including without limitation, by merger, change of control, sale of assets, or other acquisition, the acquiring organisation will obtain and have access to the Personally Identifiable Information collected by 2xanadu and it will assume the rights and obligations regarding your Personally Identifiable Information as described in this Privacy Policy. If we cease operation, your information may be transferred to and used by another company that offers similar or related products or services. While we cannot predict a great deal about such an unlikely event, we would hope this could provide you continuity of service.
Making changes:
You may review the Personally Identifiable Information we have on file by logging in and clicking the My Account button on the site. Once there, there you may modify information that is incorrect and delete certain information from your profile.
To delete your Personally Identifiable Information, you must manually change your data fields to null values. Otherwise, your data is retained indefinitely. Data related to transactions for products and services through the 2xanadu Shop is retained indefinitely. Moreover, since, Anonymous Information is not identifiable as originating with you, it cannot be reviewed or changed by you.
We may change this policy from time to time. While we will usually indicate major changes by notice on our site, please check here from time to time to see if there is a revised policy posted.
Publicly posted information
If you register as a member of the 2xanadu Sites, please remember that anything you post is publicly available. The user name you have chosen during the registration process is visible to all users of the Site. Your user profile, and the information you choose to include in your profile, however, will not be available to other users. 2xanadu does not control, and is not responsible for, the use of any information or content that you have exposed to the public through your use of the 2xanadu Sites.
Security:
We keep the Personally Identifiable Information you provide on servers that are protected by firewalls and other technological means against intrusion or unauthorised access. They are located in a physically secure facility, and only our employees and agents with a need to know the information are given access. While no amount of security can give a perfect guarantee, you can have a high degree of confidence that the personally identifiable information you give us is protected from unauthorised access and use. We rely on you to select passwords that cannot be guessed easily and to safeguard those passwords from disclosure. Please contact us if you have any information regarding unauthorised use of the 2xanadu sites.
Updates:
We may update this Privacy Policy from time to time as our services change and expand. If we update this Privacy Policy, we will notify you about significant changes by sending a notice to the email address specified in your account or by posting a notice of such changes on the 2xanadu Sites. Unless otherwise provided, the revised terms will take effect on the date they are posted. Once such changes become effective, your continued use of the Site will signify your acceptance of the new Privacy Policy. If you do not agree to the terms of this Privacy Policy, or any revised Privacy Policy, your sole and exclusive remedy is to discontinue using the Site.

Competition Rules
No purchase is necessary to enter or to win 

These Competition Rules ("Rules") are the Rules applying to the Bespoke: Design a City Bike competition organised by 2xanadu, a company based in Surrey, UK and LUMA Sport, a company based in Hong Kong, China. 2xanadu ("2xanadu ") are the Promoters of the competition.
How to enter
1. The Competition will begin at 19:00:01 hours (GMT) on 25 May 2010 and will end at 23:59:59 hours (GMT) on 19 August 2010. This period shall be referred to in these Rules as "the Competition Period".
2. To be eligible, the entrant ("Entrant") shall be required to register through the Bespoke:’s website at http://www.bespoke-bike.com ("the Competition Site" or "Site") and become a member of that Site. This is a website registered in Surrey, UK and registration is free. No purchase necessary to enter or win.
3. The Entrant must submit an entry and then follow the instructions on the Competition Site. Previous registration with the Site will not automatically result in eligibility.
4. The Entrant must submit an original piece of artwork ("Artwork") in any visual medium based on or inspired by the LUMA fixed gear.
5. The Artwork must be submitted to the gallery, using the template provided, in a digital JPEG format at 2000x2000 72dpi.
6. Entries must be received by (and no later than) 23:59:59 hours (GMT) on 19 August 2010. Proof of sending an entry shall not be proof of receipt.
7. Entrants should only submit a digital copy of the Artwork. No submitted files will be returned.
Eligibility of the Artwork
8. Artwork submitted:
a. must not have previously been published or won any other prize or award;
b. must be entirely original other than the use of Promoter’s Property and must be created originally and specifically for this contest.
c. must not, at the Promoters' sole discretion, be libelous or defamatory in any way, threatening, abusive, harassing, harmful, inflammatory or otherwise and must not contain any profanities or any unlawful material or material which could be racially, ethnically or otherwise objectionable;
d. must not contain, at the Promoters' sole discretion, any vulgar, obscene, offensive, overly violent, pornographic, sexually explicit, scandalous or otherwise inappropriate material or subject matter;
e. must not invade any person's rights or privacy (whether living or deceased) or infringe upon any person's personal or property rights and not contain any characteristics or likenesses of any public figure or celebrity whether living or dead; 

f. must not contain advertising of any nature, trademarks (whether registered or unregistered), brand names or slogans (other than those relating to the Promoters), copyrighted material or infringe intellectual property rights of any third party; and
g. must not contain any viruses, worms, corrupt files, Trojan horses or other forms of corruptive code that may harm or compromise the Competition Site and/or the proper conduct of the Competition.
h. must not violate any law or statute or encourage conduct which might give rise to a criminal or civil offence;
9. The Promoters and the judges reserve the right, using their sole discretion, to remove and disqualify from the Competition any Artwork submitted which contravenes the Rules generally or specifically rule 8 above.
10. By submitting an entry, the Entrant represents and confirms that:
a. they have the necessary rights to enter the Competition and submit the Artwork; 
b. any person whose name, voice or likeness appears in the Artwork ("Artwork Participants") have unconditionally granted to the Entrant their written consent for their name, voice or likeness to be so used in the submitted Artwork (being subject to these Rules) and that the Entrant will be able to provide the Promoters with that written consent upon request; and 
c. the Artwork does not infringe any person's or corporate entity's personal or intellectual property rights.
Use of the Artwork
11. All rights in the Artwork will remain the exclusive property of the Entrant, provided at all times that:
a. during the Competition Period and for a period of two years thereafter, eligible pieces of Artwork may, at the discretion of the Promoters, be posted on the Competition Site or otherwise displayed in any form and in any media in connection with the promotion of the Competition; 
b. by entering into the Competition, the Entrant, for a period of 5 years from the close of the Competition Period ("Display Period"), grants to LUMA, on a royalty-free and payment-free basis, the right to display any prize-winning Artwork in any form and in any media in connection with the promotion of LUMA’s business and, for the avoidance of doubt, there is no obligation on LUMA to so display any Artwork; 
c. LUMA may otherwise use prize-winning Artwork in such manner, and upon such terms and conditions, and for such payment as may be agreed with the relevant Entrant, such approval not to be unreasonably conditioned, delayed or withheld.
12. If any prize-winning Artwork is used by the Promoters as set out in rule 11 above, the Entrant shall not, during the Display Period, authorise or permit his or her prize-winning Artwork to be used to promote any product or service of any party other than the Entrant or the Promoters.
13. For the avoidance of doubt, an Entrant shall not acquire any ownership, interest or rights over any trademark (whether registered or unregistered) or other intellectual property of the Promoters ("Promoters' Property") which might appear in the Artwork.
14. Except as expressly permitted in these Rules, the Entrant may not use the Promoters' Property in any manner whatsoever in connection with the Artwork or otherwise without the relevant Promoter's express prior written permission.
Criteria for and Selection of Winners
15. After the close of the Competition Period, and using the criteria at rule 17 below full-time staff members of 2xanadu shall select 50 semi-finalist entries. The semi-finalist entries will be judged by a panel of 2xanadu, LUMA and McFaul Studio Judges, made up of Peter Lin, Louis Lui, and John McFaul. Potential winners will be selected from the Shortlist on or after 13 September 2010 by a panel of judges.
16. The judges' decisions on any aspect of the Competition are final and no correspondence or discussion will be entered into.
17. Artwork will be judged on the basis of the most creative expression of the Design a City Bike competition, applying the following criteria: creativity (40%), originality (35%) and technical skill (25%). In the event of a tie, the winner will be the entry with the highest score for creativity.
18. Winning Entrants will be notified by any of UK postal mail or email and/or through the Competition Site.
Prizes
19. a. The Grand Prize for the best design, amongst the winning designs, is the very bike frame the entrants work will end up on, including having their work on display in the exhibition, and having their work subsequently featured in Computer Arts and International Design Network Magazines.
b. All other winners will have their work displayed on one of the bikes shown at the exhibition, and featured in Computer Arts and International Design Network Magazines.
There shall be no cash alternatives.
20. The Promoters reserve the right to substitute prizes of equal or greater value but no other substitution or transfer of prizes will be permitted.
21. The odds of winning will depend on the number of eligible Artworks received and the nature of the Artwork itself and, assuming that a sufficient number of entries are received, all prizes will be awarded. 

22. Only winning Entrants will be contacted by the Promoters.
23. The Promoters reserve the right to require proof of age, address and residence from any prize winner.
24. Entrants who become prize-winners agree to the use of their name and prize information being used by the Promoters in any medium without any additional payment or compensation from the Promoters and, if the Promoters request and a prize-winning Entrant consents, their likeness.
25. The names and county of residence of the winning Entrants will be available from the Competition Site after selection and verification of the winners.
Eligibility
26. Subject to rule 27 below, the Competition is open to residents of any part of the world who are registered members of the Bespoke website and who are aged 18 or over on 1st  August 2010. Registration on the Bespoke website is free and no purchase is necessary. If an Entrant is under the age of 18, they should obtain the consent of their parent or guardian to enter the Competition and be able to demonstrate such consent upon request at any time and the Entrant represents and warrants that they have obtained the necessary consent to enter the Competition.
27. The Competition is not open to employees (or their immediate families and members of the same household) of the Promoters or their affiliates, agents, advertising and promotion agencies or the judges (or their immediate families and members of the same household).
28. Any entry received from a person who is not eligible shall not be considered by the judges. 
General
29. Acceptance of these Rules shall be a condition of entry and submission of an Artwork shall be deemed as acceptance of the Rules.
30. The Entrant agrees to abide by the decisions of the judges.
31. The Promoters and judges shall be neither responsible nor liable for:
a. any late, delayed, lost, misdirected, damaged, incomplete, corrupted or otherwise defective entries or communications whether as a result of technical or other failures or malfunctions of computer hardware, software, communications devices or otherwise, nor for any data corruption, theft, unauthorised access to or alteration of Artwork, loss or otherwise;
b. any electronic communications being blocked, delayed or returned as a result of any communications/data filtering system employed or if the Entrant's email account has insufficient space to allow receipt of any email;
c. any breach of a third party's rights by an Entrant (whether intellectual property rights or otherwise) in connection with any submitted Artwork; or
d. any damage caused to an Entrant's computer system as a result of participation in the Competition or from any access made, posting, uploading or downloading of data or information to or from the Competition Site or from any website of the Promoters in connection with the Competition.
32. The Promoters, in their sole discretion, reserve the right at all times to modify, suspend, cancel or terminate the Competition should any virus, bug, technical failure, unauthorised human intervention or other event beyond the reasonable control of the Promoters corrupt, jeopardize or otherwise affect the administration, security, fairness or proper conduct of the Competition. In the event of such cancellation, termination or suspension, an advice notice will be posted on the Competition Site and the winners shall be selected from the eligible entries received prior to such time.
33. By accepting a prize, a winning Entrant agrees to release the Promoters, their directors, employees, officers and agents including, without limitation, their advertising and promotion agencies from any liability to the Entrant, any direct or indirect losses (including consequential losses) or damages whatsoever and howsoever arising from or in connection with the awarding, receipt and/or use or misuse of the prize or participation in any prize-related activities provided that nothing in these Rules shall exclude or limit the liability of the Promoters for personal injury or death caused by negligence or anything else that cannot be excluded or limited by law.
34. Any attempt by an Entrant to deliberately damage the Competition Site or any site connected with the Promoters or otherwise undermine the legitimate operation of the Competition is a violation of criminal and civil laws and should such an attempt be made, the Promoters reserve the right to take whatever legal action may be necessary against, and to seek damages from, any such individual to the fullest extent permitted by law.

36. If any provision of these Rules (or part of any provision) is found by any court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision or part-provision shall, to the extent required, be deemed not to form part of these Rules, and the validity and enforceability of the other provisions of the Rules shall not be affected.
37. These Rules shall be governed by and construed in accordance with the law of England and Wales (in the United Kingdom). The Entrant agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with either these Rules or the Competition.
